The common term for certain legal “Tort” actions:
Personal injury cases are typically precipitated by the negligence of one person which causes damage to another. Types of personal injury cases include: wrongful death, auto accidents, traffic accidents, slip/trip and fall accidents, defective products, and medical negligence. Generally, four elements must be proved for a successful personal injury case:

  1. A duty on the part of a defendant
  2. A breach of the duty by the defendant
  3. The breach must be the actual and proximate cause of the plaintiff’s injuries
  4. Damage
